Nintendo brings the lawsuit pain to flashcart pirates

If there’s one reason why game systems can fail, it’s because of those damn pirates. The Nintendo DS was hit with this scourge during its lifecycle, as R4 cards allowed gamers to download and play to their hearts content. The 3DS has been largely free of this though, thanks to Nintendo striking back. And it just found another culprit attempting to wreck that system.

Nintendo announced a couple of hours back that they’ll be cracking down on South Florida-based website HackYourConsole.com. The website has been selling DS flashcarts, as well starting to collect preorders for the upcoming Gateway 3DS card. Sure, that’ll most likely be murdered with supreme update justice once Nintendo get their hands on it, but it’ll still be financially damaging until that is done.

The press release via Business Wire had a few words from Renegade Kid’s Jools Watsham on the matter:

Piracy on the Nintendo DS system has a huge impact on games sales. It can affect everyone involved, including the many honest players out there. If independent studios, like ours, are unable to recoup the money they invest into game development, through the sales of their games, we will unfortunately see fewer independent games developed in the future.

Some of you will argue that you’ll want these flashkarts for homebrew uses. At which point I’ll tell you that the word ‘gullible’ isn’t listed in the dictionary. The 3DS is just starting to become a really great handheld device now, with some fantastic games on the way. And I don’t want to see that momentum scuppered at all with piracy.

Piracy makes it bad for everyone, and we all know that it leads to publishers and developers overreacting, making life worse for the honest gamer out there. So if there are any Nintendo reps reading this, here’s something else for you: A ton of these R4 cards are on sale locally, so here’s your chance to help out. Get ‘em. GET ‘EM!

      I personally think $40 is good. It’s not a cell phone it takes a hell of alot more to develop for a 3ds than a SGSIV.

        Seems its expensive in the UK then because here it is £40 great Briton pound which is $62.02 dollars, so we are paying $20 dollars more then you.

      Expensive is not an argument for Piracy. If it is too expensive then don’t buy it, or save up and appreciate when you do get it. Just because piracy is easier than stealing the game in the shop doesn’t make it right.

    I agree with this article. If you can’t afford a game then save up the money or buy it used because its usually cheaper used. And I hope that Nintendo is going to sue the hell out the company that is making the 3DS R4 card.

    Yeah sue them and jail them, take all their money. Nintendo a great company that I love since my childhood. Its just crazy what piracy does, imagine you make something really great, and somebody just take that something for their own purpose or needs.

    Nintendo is lazy for USA anti piracy. This guy doesn’t even use anything to hide himself and all his information is out to the public. he has literally posted thousands of illegal Nintendo ROM and ISO dumps on usenet and ftp sites as well as on the web.
